Handling of hazardous waste
The term "waste" is defined by Act No. 185/2001 Coll. as every movable thing a person disposes of or intends to dispose of.
According to the Waste Act, the disposal of waste happens in the following ways:
- transfer of movables for further use or disposal within the meaning of the Waste Act,
- handing to the person authorized to collect or purchase waste under the Waste Act,
- removal of movables by the person alone.
The law also regulates the waste management and requires the general obligation to prevent waste, reduce the amount and hazardous properties. However, if the generation of waste cannot be avoided, waste must be used or disposed of in a manner that protects human health and the environment and is consistent with the law.
The Waste Act defines that the waste management and the waste disposal can be realized only by the manner prescribed by the law and other legal regulations issued for the environmental protection.
Hazardous waste management and its disposal is subject to special regulations applicable to the products, substances and preparations with the same hazardous properties. Unless the Waste Act provides otherwise, the waste can be handled only in facilities that are designed for waste management. Such a treatment must not endanger the human health nor the environment.
Pollution limits, given by special legislation, must not be exceeded. The special legislation is for example Act No. 201/2012 Coll., on air protection (Clean Air Act), as amended, or Act No. 254/2001 Coll. on waters (Water Act), as amended.
